SCOPIC CLAUSE Sample Clauses

A Scopic Clause is a contractual provision commonly used in marine salvage agreements to supplement standard salvage terms, particularly when dealing with environmental threats. It activates additional compensation mechanisms for salvors when the operation involves preventing or minimizing environmental damage, such as oil spills from a grounded vessel. The clause sets out specific procedures for notification, assessment, and calculation of extra remuneration based on the nature and extent of the environmental risk. Its core practical function is to incentivize salvors to undertake environmentally sensitive operations by ensuring they are fairly compensated for the additional risks and efforts involved, thereby addressing the problem of insufficient motivation under traditional salvage terms.
