Common use of SCN Events of Default Clause in Contracts

SCN Events of Default. SCN shall be in default under this Agreement upon the occurrence of any of the following: IX.3.1. In the event of the filing of a petition in voluntary bankruptcy or an assignment for the benefit of creditors by SCN, or upon other action taken or suffered, voluntarily or involuntarily, under any federal or state law for the benefit of debtors by SCN, except for the filing of a petition in involuntary bankruptcy against SCN which is dismissed within thirty (30) days thereafter. IX.3.2. In the event that SCN shall intentionally or in bad faith violate Applicable Law resulting in a direct, continuing material adverse effect on the operations, earnings and cash flow of MRS II.
