The "SCC determinations" clause defines how decisions or interpretations related to Standard Contractual Clauses (SCCs) are made within the agreement. Typically, this clause outlines which party or authority is responsible for assessing compliance with SCC requirements, such as data protection standards for international data transfers. For example, it may specify that a designated data protection officer or legal counsel will review and determine whether certain data processing activities meet SCC obligations. SCC determinations. (a) The SCC will notify the Employer (and Employee where applicable) of the outcome of the application in writing within 14 days of the decision.
(b) The determined grade will apply from the date of the application or a later date determined by the SCC.
(c) Until the determination of the SCC, the existing grade (where relevant) will continue to apply.
(d) In the event an Employee is in a position that the SCC, or on review, the Commission determines to be at a lower grade than the Employee’s current grade, the Employee will have their current salary maintained.
