RULES / INSTRUCTION CLASSES. A. Trainmen who are required to attend rules or instruction classes on their own time shall be paid actual time, except that no pay shall be required for Trainmen attending remedial classes in lieu of or as part of the discipline process or as described below. The Company will schedule the rules and instructions classes for the Trainmen. B. Where training takes place away from the Trainman's home terminal, lodging will be provided, and the Trainman shall be entitled to allowances for meals and for expenses related to travel (Examples: fares, tolls, parking, mileage) between the home terminal and the course accommodation. C. Where an examination or test forms part of the training requirement, a Trainman is expected to meet the required standard on the first attempt. If an individual is unable to achieve the necessary standard, he will be offered one additional opportunity to successfully pass the failed portion(s) (without compensation) and which must take place within not less than five (5) nor more than fourteen (14) days of the first attempt and which will be on the Trainman’s own time. A Trainman who fails to attain the required standard at the completion of this period will be deemed to have disqualified himself for employment and will forfeit all seniority. D. Trainmen who are required to attend rule, Trainman re-certification, or instruction classes during a normal tour of duty (i.e.; combined with other service) will not be paid additional compensation. E. Regular Trainmen who lose earnings as a result of being required to attend rule or instruction classes shall be paid for time lost at the Non-Service rate of the position to which assigned. F. Extra Trainmen required attending rule, Trainman re-certification, or instruction classes will be paid for any loss of time at the Non-Service rate and in no case will be paid less than actual time in attendance. Trainmen required at the request of the Company to attend the classes referred to herein on their assigned rest days shall be paid for such service at the rate of time and one half.

No pay shall be required for Trainmen attending remedial classes in lieu of or as part of the discipline process or as described below. C. Where an examination or test is part of the training requirement, a Trainman is expected to meet the required standard on the first attempt. If a Trainman is unable to achieve the necessary standard, they shall be offered additional training (without compensation) and shall be afforded further opportunities to retake the examination, which must take place within ten (10) days of the first attempt and which shall be on their own time. A Trainman who fails to attain the required standard at the completion of this period, subject to an investigation, may be deemed to have disqualified themselves for employment and shall forfeit all seniority. D. Trainmen who are required to attend rule or instruction classes during a normal tour of duty (i.e., combined with other services) shall not be paid additional compensation.

Employees must satisfactorily complete instruction classes on Operating Rules, Safety Rules, Air Brakes and subject matter related thereto covering the CN (former GTW territory) over which they may operate. In no event is the interval of time between the completion of classes to exceed two years. Classes will be scheduled at terminals at times that are compatible with assignments operating from those terminals such that adequate opportunity is provided for all to attend. The Local Chairmen will be consulted concerning the scheduling of classes.
