Rule 404 Clause Samples

Rule 404 is a provision in the Federal Rules of Evidence that governs the admissibility of character evidence in legal proceedings. Specifically, it generally prohibits the use of evidence about a person's character or prior bad acts to prove that they acted in accordance with that character on a particular occasion, such as using a defendant's criminal history to suggest guilt in a current case. However, there are exceptions, such as when character is an essential element of a charge or defense, or in certain cases involving witnesses. The core function of Rule 404 is to prevent unfair prejudice and ensure that verdicts are based on relevant facts rather than assumptions about a person's character.
