Roadway CIP Sample Clauses

Roadway CIP. No later than the next statutory required update to the Roadway CIP (or promptly upon Developer’s request and at Developer’s expense), the City shall amend the Roadway CIP to include ▇▇▇▇▇▇▇▇▇ and CR 398 as Capital Improvements. If Developer incurs costs in connection with South ▇▇▇▇▇▇▇▇▇ Boulevard or CR 398 before they are included in the Roadway CIP, and such costs would otherwise qualify as Capital Improvement Costs, Developer shall be entitled to Impact Fee Credits for those costs as if South ▇▇▇▇▇▇▇▇▇ Boulevard and CR 398 were Capital Improvements as of the date Developer incurred such costs. In the event the City fails to include South ▇▇▇▇▇▇▇▇▇ Boulevard or CR 398 on the Roadway CIP as contemplated by this paragraph, the City shall finance and/or reimburse Developer for the total cost of said roadways from sources other than those derived from the PID.
