Common use of Right to Require Performance Clause in Contracts

Right to Require Performance. The failure of CITY at any time to 6 require performance by CONTRACTOR of any provision hereof shall in no way affect 7 the right of CITY thereafter to enforce same. Nor shall waiver by CITY of any breach of 8 any provision hereof be taken or held to be a waiver of any succeeding breach of such 9 provision or as a waiver of any provision itself.
