Common use of Right to Repurchase Clause in Contracts

Right to Repurchase. CLAUSE 4 -------- Purchaser herewith grants to the Seller the right to repurchase all but not less than all of the Shares if by 1 August 2000 the Firm Offer will not have been consummated. Such right can be exercised during a period of three months following 1 August 2000. Repurchase of the Shares shall be at the same price as the price paid by Purchaser to Seller under this Agreement. In case Seller wishes to exercise its right granted in this clause 4, Seller shall give notice in writing to Purchaser and the sale and transfer of the Shares to be repurchased shall take place within 10 business days following the date of the notice.

In case Seller wishes Sellers wish to exercise its right their rights granted in this clause 4, Seller Sellers shall give notice in writing to Purchaser and the sale and transfer of the Shares to be repurchased shall take place within 10 business days following the date of the notice.
