Returned or NSF Checks. Landlord has a zero tolerance policy for insufficient (NSF) checks or declined payments of any kind. A check from Tenant which is NSF or otherwise declined is a breach and default under this Lease for which Tenant may be evicted. However, if Landlord elects (at Landlord’s discretion) to allow Tenant to remain on the Property after tender of an NSF or declined check, Tenant will pay Landlord an NSF fee of $100.00 for each check or payment that Tenant tenders to Landlord which is NSF or returned by the institution on which it is drawn for any reason, plus any late charges that may accrue until Landlord receives payment in immediately good funds.
