Return or Destroy PHI on Termination Clause Samples

The "Return or Destroy PHI on Termination" clause requires that, upon the end of a contract or business relationship, any protected health information (PHI) held by a party must either be returned to the disclosing party or securely destroyed. In practice, this means that a service provider or business associate must identify all PHI in their possession and take steps to either transfer it back or render it irretrievable, except where retention is required by law. This clause is essential for safeguarding sensitive health information after a partnership ends, ensuring that PHI is not improperly retained or exposed, and thereby reducing the risk of unauthorized access or data breaches.
