Retitling Sample Clauses

Retitling. An account owned by one (1) or more individuals may be titled or retitled in the name of a trust and not in the name of the individuals if all of the following are met: a. The trust is eligible for membership in the Credit Union. b. Each owner consents, in writing, to titling or retitling the account in the name of the trust. c. Any beneficiaries listed on the account are removed as beneficiaries by the owners. d. The account is not an account that provides tax deferrals or any other tax benefit under state or federal law. e. Outstanding loans have been fully paid and closed.

Retitling. (a) If, at any time, a Service Transfer has occurred and CITSF is no longer the Servicer, and the new Servicer is unable to foreclose upon a Manufactured Home because the title document for such Manufactured Home does not show such Servicer or the Trustee as the holder of the first or second priority security interest in the Manufactured Home, such Servicer shall take all necessary steps to apply for a replacement title document showing it or the Trustee as the secured party. (b) In order to facilitate the Servicer's actions, as described in subsection (a) of this Section 5.12, CITSF will provide the Servicer with any necessary power of attorney permitting it to retitle the Manufactured Home. (c) If the Servicer is still unable to retitle the Manufactured Home, CITSF will take all actions necessary to act with the Servicer to foreclose upon the Manufactured Home, including, as appropriate, the filing of any UCC financing statements necessary to perfect the security interest in any Manufactured Home that constitutes a fixture under the laws of the jurisdiction in which it is located and all actions necessary to perfect the security interest in any Manufactured Home that is considered or classified as part of the real estate on which it is located under the laws of the jurisdictions in which it is located, where feasible.

Retitling. If requested by the Administrator, the Borrower shall require, in accordance with Section 2.10 of the Trust Agreement, that each certificate of title relating to a Series 1998-C Leased Vehicle be retitled in the name of the Borrower, that Administrator, for the benefit of the Lenders, be noted on such certificate as the sole lienholder with respect thereto and that, if requested by the Administrator, such certificates be transferred to the possession of the Administrator if the rating of the Guarantor's senior unsecured long-term debt by each of Moody's Investor's Service, Inc. and Standard & Poor's Rating Group is reduced (or suspended or withdrawn) to or drops below "Baa3" and "BBB-", respectively; provided, however, that if the Borrower fails to take such action, the Administrator shall have the right to do so in accordance with Section 2.10 of the Trust Agreement.

Retitling. In connection with the acquisition by the Lessor of Vehicles pursuant to Sections 2.1(b) and 2.1(d), the Lessee requesting the acquisition of such Vehicle shall, within thirty (30) days of such acquisition, complete the retitling process with respect to such Vehicle, naming the Lessor as the owner of such Vehicle on the related Certificate of Title and noting thereon the Trustee's security interest in such Vehicle; provided, however, that such Lessee shall provide the Trustee with written notice of the completion of such retitling process.
