The 'Resuming implementation' clause defines the conditions and procedures under which a previously suspended project or contractual obligation can recommence. Typically, this clause outlines the steps both parties must take to restart work, such as providing written notice, agreeing on a new timeline, or addressing any outstanding issues that led to the suspension. Its core practical function is to ensure a clear and orderly process for getting a project back on track after an interruption, minimizing confusion and disputes about how and when work should resume.
Resuming implementation. In order to resume the implementation, the beneficiary must meet the notified conditions as soon as possible and must inform Frontex of any progress made. If the conditions for resuming the implementation are met or the necessary verifications are carried out, Frontex must send a formal notification to the beneficiary:
(a) informing it that the conditions for lifting the suspension are met; and
(b) requiring it to present a request for amendment of the Agreement as provided for in Article II.16.
