Restricted Usage. The restricted usage of data product(s) licensed under this agreement, and acceptance of data for such use, or so used, shall indicate LICENSEE'S agreement to indemnify and hold harmless the LICENSOR, and any and all member entities of the Regional Accela Permits and License Program located in northwestern Nevada, including their agents, consultants, contractors and employees, from any and all liability claims or damages to any person or property arising from, or in connection with such usage. 1) No jurisdiction shall use or prepare data on behalf of another jurisdiction in whole or in part, without context, definition and consent of that agency. 2) The following is deemed confidential and shall not be permitted for any agency to report against as specified herein: • Health Module data, Record Types: All permits under Health to include the following types and all subtypes under each record: Health/Air Quality, Health/Food, Health/Food Permit, Health/Foodborne Disease, Health/Historical, Health/Institution, Health/Invasive Body Decoration, Health/Limited Advisory, Health/Mobile Home Park – RV Parks, Health/POS, Health/Public Accommodations, Health/Public Bathing, Health/Underground Storage Tank, Health/Variance, Health/Waste, Health/▇▇▇▇▇, and the COVID Record Type Group. • Enforcement data • Redacted data names • Business License Applications, social security numbers, gross receipts, and other data as identified by NRS, NAC, or City Code. • Code Enforcement • Redacted data names • Any records/information which have the custom list with the Business Activity of "Dancer Cabaret" (and the older "Entertainer" activity), • Any records/information which receive the "no ACA access" flag, regardless of record type (I.e. all four APP; LIC; AMD; RWL).

Restricted Usage. You, the Licensee, understand and agree to the following restrictions on the use of Licensed Content. If you desire to develop an End Product for such uses, additional licensing is required and fees may apply. ● Unlawful Use – You, the Licensee, will not use Licensed Content in any defamatory manner, or in violation of any applicable laws. ● Pornographic Use – You, the Licensee, will not use Licensed Content in relation to any pornographic subject matter. ● Sensitive Use Disclaimer –You, the Licensee, will not use Licensed Content in connection with subject matter that could be interpreted as controversial in nature. ● You, the Licensee, shall not use the Licensed Content in any way that might be considered libelous, obscene, including drug or alcohol use, tobacco use, violent, content deemed appropriate for mature audiences only, or in any immoral or illegal way. ● You, the Licensee, shall not use the Licensed Content for any National/International Broadcast- commercial, TV, motion picture, cinematography film, or photoplay with a production budget of more than $45,000. ● You, the Licensee, shall not use the Licensed Content for any Internet or television commercial, including cable channels, with a budget of more than $5,000 for production & airing. ● You, the Licensee, shall not use the Licensed Content for any internet or television, including cable channels, shows with a budget of more than $7,500 per episode. ● You, the Licensee, shall not use the Licensed Content and Movie- motion picture, cinematography film or photoplay with a production budget of more than $50,000. ● You, the Licensee, shall not use the Licensed Content to create digital templates unless such templates are used solely for marketing Licensee’s own business. Restricted Usage. In addition to use restrictions set forth elsewhere in the Agreement and its Appendices, the Licensed Data may not be marketed to companies primarily engaged in facilitating real estate commerce, or who redistribute data for direct marketing purposes. Further, the Licensed Data may not be used to develop models or indexes for the purpose of valuing real estate properties, nor may the data be produced or distributed on CD-ROM.
