Restricted Days Clause Samples

The Restricted Days clause defines specific dates or periods during which certain contractual activities, such as deliveries, services, or performance obligations, are not permitted. Typically, these days may include public holidays, weekends, or other dates mutually agreed upon by the parties, and the clause ensures that no work or obligations are scheduled during these times. Its core practical function is to prevent disruptions or conflicts by clearly identifying blackout periods, thereby helping both parties plan their activities and avoid misunderstandings regarding scheduling.
Restricted Days. Business leave may not be used during the first or last five (5) days of student attendance, immediately prior to or following vacation periods, holidays, or on School Improvement Plan (SIP)/in-service/parent-teacher conference days when students are in attendance. Family Business Day – Two of the three business leave days may be used for family business on a restricted day if the staff member submits written documentation to the assistant superintendent for human resources that the family business cannot be scheduled on a non-restricted day. In addition the family business day cannot be used for recreation, shopping, and/or vacation.

Restricted Days. On the Restricted Days, ATN shall provide the Reports, and the Broadcaster shall broadcast, the Tags in accordance with the Restricted Broadcasting Schedule, but otherwise in accordance with this agreement.
Restricted Days. Personal Leave may not be used the first or last week of school; to extend a holiday (includes all school breaks), or pre-scheduled sick leave; or on mandatory training days unless extenuating circumstances are granted by the Assistant Superintendent of Human Resources prior to the absence. Prior to approving or denying the request, the Assistant Superintendent of Human Resources, or designee, will seek input from the department supervisor for the employee making the request to determine if granting the exception would be operationally feasible. Personal leave requests on these restricted days will be reviewed for approval on a first come, first serve basis.

A teacher may request that his/her principal approve a day as excused without pay if he/she needs to be absent on a day restricted for business leave use. In the case of an extenuating circumstance, the teacher may request use of a business leave day during the restricted time only from the Assistant Superintendent of Human Resources. An extenuating circumstance will be considered as an extraordinary, unusual, and unplanned situation.
Restricted Days. Non-emergency Discretionary Leave days taken the first or last five (5) student contact days will result in a two (2) for one (1) hourly deduction from the teacher’s Discretionary Leave.
