Responsibility for Overdraft. If you obtain cash from an ATM which creates an overdraft in your savings account, the overdraft amount is due and payable the moment you get it and you agree to pay the full amount of it to us. You also authorize us, in such a case, to apply from any other shares you may have at MSUFCU such amount as may be necessary to pay such overdraft amount. If the overdraft is created in your checking account, (1) a transfer will be made from your other share account(s) to cover the overdraft, in accordance with your checking account agreement with us, (2) an advance on your line-of-credit loan account with us will be made to cover the overdraft and you will repay that advance in accordance with the terms and conditions of your line-of-credit plan, or (3) if you do not have a line of credit with us but qualify for our overdraft Courtesy Pay program, we may cover the overdraft and assess a fee as disclosed in our Fee Schedule. If there are not sufficient funds to make a transfer according to (1) or (2) of this sentence, or if you do not qualify for overdraft Courtesy Pay, then such overdraft will be paid to us as provided in the first sentence of this section.

Responsibility for Overdraft. Unless an overdraft is governed by a separate contractual relationship with us, if any authorized electronic funds transfer creates an overdraft in your Share and/or Checking Account(s), the overdrawn amount is due and payable the moment the overdraft occurs. You agree to pay the fullamount by which the account is overdrawn together with any applicable fees upon our demand. In addition, you also authorize us, in such a case, to apply from any other shares or deposits you have in the Credit Union such amounts as are necessary to repay the overdrawn amount and any applicable fees; however we may not make such a transfer from an Individual Retirement Account or other account permitting tax deferrals or providing other tax benefits under state or federal law. FEES We may charge you fees for electronic fund transfers as set forth in this EFT Disclosure or as set forth in our Fee Schedule. We reserve the right to amend the fees from time to time upon thirty (30) days prior written notice. In addition, if you use an ATM or other terminal not owned by us to complete a transaction or make a balance inquiry, the owner of that ATM or network may charge you a fee.

You also authorize us in such case to apply from any other savings account, checking account, club account or line of credit you may have in the Credit Union such amount as to be necessary to pay the overdraft amount and service charge.

You also authorize us, in such a case, to apply from any other shares or deposits you may have in the credit union any amount necessary to pay such overdraft and fees. If the overdraft is created in your Share Draft / Checking Account, (1) a transfer will be made from your other share account(s) to cover the overdraft, in accordance with your share draft account agreement with us, or (2) if you have an overdraft line of credit, an advance on your line of credit will be made to cover the overdraft, and you will pay that advance in accordance with the conditions of your line of credit plan, depending upon which form of overdraft protection you have selected. If there are not sufficient funds to make a transfer according to (1) or (2) of this paragraph, or if you have no overdraft protection for your Share Draft / Checking Account, then such overdraft will be paid to us as provided in the first sentence of this section. Crediting of Deposits and Payments. Deposits or payments made in an ATM, whether in cash, check, draft or money order, are subject to verification, and the funds of such deposits and payments to share, share draft or loan accounts may be held until they can be collected from the machine, verified and entered into our accounting systems. Further delay may occur if the transaction is made on or immediately prior to a Saturday, Sunday or holiday on which we are closed. If you place a check, draft or money order in the machine as a deposit or payment, it is subject to collection in accordance with your account agreement with us and Regulation CC.
Responsibility for Overdraft. If an overdraft in your account(s) is created through your use of “electronic fund transfers” as described in Subsection E, or because of fees and charges relating to those “electronic fund transfers,” the overdraft amount and a non-sufficient funds or overdraft fee is due and payable the moment you get it, unless you are notified otherwise by the Credit Union. You also authorize us, in such a case, to apply from any other shares or deposits you may have in the Credit Union such amount as may be necessary to pay such overdraft amount and fee. If a check or ACH debit is presented for authorization or payment to your Business Checking Account for which there are non-sufficient funds (NSF) available and you have selected to have Overdraft Protection available for your checking account, (1) a transfer will be made from your other share or deposit account(s), as you have designated, in an amount sufficient to cover the overdraft, or (2) an advance on your Overdraft Protection line-of-credit loan account with us will be made to cover the overdraft and you will repay that advance in accordance with the terms and conditions of your Overdraft Protection line-of-credit plan, depending upon which form of overdraft protection you have selected. But, if there are not sufficient funds to make a transfer according to (1) or (2) of this section, or if you have no Overdraft Protection for your Business Checking Account, the check or ACH debit may be denied and returned to the third-party presenter without payment, and your account will be charged a non-sufficient fund fee. In the sole discretion of the Credit Union, a check, ACH debit, merchant purchase or other debit may be honored, creating an overdraft in your Business Checking Account and you will owe the Credit Union the amount of the overdraft, plus an overdraft fee. If an ACH debit is presented for payment to your share account(s) for which there are non-sufficient funds available, it may be returned to the third-party presenter without payment, and your account will be charged a non-sufficient fund fee. Refer to fees in our current Business Accounts Fee Schedule. We reserve the right to change fees, upon notice, in the future.

You agree to pay the full amount of the overdraft to us, together with any fees incurred. You also authorize us, in such a case, to apply from any other shares or deposits you may have in the credit union such amount as may be necessary to pay such overdraft, in accordance with your checking account agreements with us. We may offer a discretionary, non contractual means of paying your overdrafts. Unless we advised you otherwise, your card allows you to access overdraft protection on your [checking or share draft] account subject to the limits we have established. You agree to repay any overdraft and any overdraft fees caused by using your card. Unless stated on your ATM’s screen, a sign near the ATM, and/or your transaction receipt, your stated account balance does not include this overdraft protection. You understand that even if you check your account balance immediately prior to using your card, items such as checks you have written or recent credit/debit activities may not yet have been posted to your account. You may also, for example, have sufficient funds to use your card, but still cause an overdraft on a check that had not yet been processed. If you want to avoid an overdraft, you agree to reconcile your account by checking your periodic statements and any outstanding unpaid items before using your card.
