Common use of Requisition for Use Clause in Contracts

Requisition for Use. In the event of a requisition for use by any government during the Term of the Airframe and the Engines, if any, or engines installed on the Airframe (including the Government pursuant to the CRAF Program), the Lessee shall promptly notify the Lessor and the Owner Participant of such requisition and, if the same does not constitute an Event of Loss, all of the Lessee's obligations under this Lease shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Lessee shall have been prevented or delayed by such requisition, provided that the Lessee's obligations for the payment of money and under Section 9 (except, in the case of Section 9, while an assumption of liability by the government of the United States of the scope referred to in Section 5(c) is in effect) and Section 12 shall not be reduced, delayed or affected by such requisition. Any payments received by the Lessor or the Lessee from such government with respect to the use of such Airframe or Engines during the Term shall be paid over to, or retained by, the Lessee and any payments received by the Lessor or Lessee from such government with respect to the use of the Airframe or Engines after the Term shall be paid over to, or retained by, Lessor. In the event of an Event of Loss of an Engine resulting from the requisition for use by a government of such Engine (but not the Airframe), the Lessee will replace such Engine hereunder by complying with the terms of Section 7(e) and any payments received by the Lessor or the Lessee from such government with respect to such requisition shall be paid over to, or retained by, the Lessee.

Requisition for Use. In the event of a requisition for use by any government during government, so long as it does not constitute an Event of Loss, of an Airframe (with or without the Term of the Airframe and the Engines, if any, Engines or engines installed on such Airframe) during the Airframe (including the Government pursuant to the CRAF Program)Lease Term, the Lessee shall promptly notify the Lessor and the Owner Participant of such requisition and, if the same does not constitute an Event of Loss, and all of the Lessee's ’s obligations under this Lease shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Lessee shall have been prevented or delayed by such requisition; provided, provided however, that the Lessee's ’s obligations for the payment of money and under Section 9 11 hereof (except, in the case of Section 9, except while an assumption of liability indemnity by the government of the United States of the scope referred to in Section 5(c11 (b) is shall be in effect) and Section 12 shall not be reduced, reduced or delayed or affected by such requisition. Any payments received by the Lessor or the Lessee from such government with respect to such requisition of use shall after reimbursement of the use of Lessor and the Finance Lessor for costs and expenses incurred in connection with such Airframe or Engines during the Term requisition and all other Rent then due, shall be paid over to, or retained by, the Lessee and any payments received by the Lessor or Lessee from such government with respect to the use of the Airframe or Engines after the Term shall be paid over to, or retained by, LessorLessee. In the event of an Event of Loss of an Engine resulting from the requisition for use by a government of such Engine (but not the an Airframe), the Lessee will shall replace such Engine hereunder by complying with the terms of Section 7(e10(b) and after such replacement any payments received by the Lessor or the Lessee from such government with respect to such requisition shall be paid over to, or retained by, the Lessee.

Requisition for Use. In the event of a requisition for use by any government during the Term of the Airframe and the Engines, if any, or engines installed on the Airframe (including the Government pursuant to the CRAF Program)Airframe, the Lessee Obligors shall promptly notify the Lessor Lead Secured Party and the Owner Participant Secured Parties of such requisition and, if the same does not constitute an Event of Loss, all of the Lessee's Obligors' obligations under this Lease Aircraft Security Agreement shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Lessee Obligors shall have been prevented or delayed by such requisition, provided that the Lessee's Obligors' obligations for the payment of money and under Section 9 3.3(i) (except, in the case of Section 93.3(i), while an assumption of liability by the government Government of the United States of the scope referred to in Section 5(c3.3(c) is in effect) and Section 12 shall not be reduced, delayed or affected by such requisition. Any payments received by the Lessor Lead Secured Party or the Lessee Obligors from such government with respect to the use of such Airframe or Engines during the Term shall be paid over to, or retained by, the Lessee and any Obligors; provided that, if such requisition constitutes an Event of Loss, then all of such payments received by the Lessor or Lessee from such government with respect to the use of the Airframe or Engines after the Term shall be paid over toto the Lead Secured Party (so long as the Lien of this Aircraft Security Agreement has not been duly discharged), or retained by, Lessorand held and applied as provided in Section 3.4(e). In the event of an Event of Loss of an Engine resulting from the requisition for use by a government of such Engine (but not the Airframe), the Lessee Obligors will replace such Engine hereunder by complying with the terms of Section 7(e3.4(h) and any payments received by the Lessor Lead Secured Party or the Lessee Obligors from such government with respect to such requisition shall be paid over to, or retained by, the LesseeObligors.

Any payments received by the Lessor or the Lessee from such government with respect to the use of such Airframe or Engines during the Term shall be paid over to, or retained by, the Lessee and any payments received by the Lessor or Lessee from such government with respect to the use of the Airframe or Engines after the Term shall be paid over to, or retained by, Lessor. In the event of an Event of Loss of an Engine resulting from the requisition for use by a government of such Engine (but not the Airframe), the Lessee will replace such Engine hereunder by complying with the terms of Section 7(e) and any payments received by the Lessor or the Lessee from such government with respect to such requisition shall be paid over to, or retained by, the Lesseein accordance with Section 8(e).
