Common use of Requisition for Use Clause in Contracts

Requisition for Use. In the event of a requisition for use by any Government Entity of the Airframe and the Engines, if any, or engines installed on such Airframe while such Airframe is subject to the Lien of this Trust Indenture, the Owner shall promptly notify the Mortgagee of such requisition and all of the Owner’s obligations under this Trust Indenture shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Owner shall have been prevented or delayed by such requisition; provided that the Owner’s obligations under this Section 4.05 with respect to the occurrence of an Event of Loss for the payment of money and under Section 4.06 (except while an assumption of liability by the U.S. Government of the scope referred to in Section 4.02(c) is in effect) shall not be reduced or delayed by such requisition. Any payments received by the Mortgagee or the Owner or Permitted Lessee from such Government Entity with respect to such requisition of use shall be paid over to, or retained by, the Owner. In the event of an Event of Loss of an Engine resulting from the requisition for use by a Government Entity of such Engine (but not the Airframe), the Owner will replace such Engine hereunder by complying with the terms of Section 4.04(e) and any payments received by the Mortgagee or the Owner from such Government Entity with respect to such requisition shall be paid over to, or retained by, the Owner.

Requisition for Use. In the event of a requisition for use by any Government Entity of the Airframe and the Enginesany Airframe, Engine or Spare Engine, if any, or engines installed on such Airframe while such Airframe is subject to the Lien of this Trust IndentureC Mortgage, the Owner Company shall promptly notify the Mortgagee Collateral Agent of such requisition and all of the OwnerCompany’s obligations under this Trust Indenture C Mortgage shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Owner Company shall have been prevented or delayed by such requisition; provided that the OwnerCompany’s obligations under this Section 4.05 3.05 with respect to the occurrence of an Event of Loss for the payment of money and under Section 4.06 3.06 (except while an assumption of liability by the U.S. Government of the scope referred to in Section 4.02(c3.02(c) is in effect) shall not be reduced or delayed by such requisition. Any payments received by the Mortgagee Collateral Agent or the Owner Company or Permitted Lessee from such Government Entity with respect to such requisition of use shall be paid over to, or retained by, the OwnerCompany. In the event of an Event of Loss of a Spare Engine or of an Engine resulting from the requisition for use by a Government Entity of such Engine (but not the an Airframe), the Owner Company will replace such Engine or Spare Engine hereunder by complying with the terms of Section 4.04(e3.04(e) and any payments received by the Mortgagee Collateral Agent or the Owner Company from such Government Entity with respect to such requisition shall be paid over to, or retained by, the OwnerCompany.

Requisition for Use. In the event of an Event of Loss of an Engine resulting from the requisition for use by a Government Entity of such Engine (but not the an Airframe), the Owner will replace such Engine hereunder by complying with the terms of Section 4.04(e2.04(e) and any payments received by the Mortgagee or the Owner from such Government Entity with respect to such requisition shall be paid over to, or retained by, the Owner.

Requisition for Use. In the event of a requisition for use by any Government Entity government of the Airframe Airframes and the Engines, if any, or engines installed on such Airframe while such Airframe is subject to the Lien of this Trust Indentureany Airframe, the Owner Grantor shall promptly notify the Mortgagee Agent of such requisition and and, if the same does not constitute an Event of Loss, all of the OwnerGrantor’s obligations under this Trust Indenture Security Agreement shall continue to the same extent as if such requisition had not occurred except to the extent that the performance or observance of any obligation by the Owner Grantor shall have been prevented or delayed by such requisition; , provided that the OwnerGrantor’s obligations under this Section 4.05 with respect to the occurrence of an Event of Loss for the payment of money and under Section 4.06 3.3(k) (except except, in the case of Section 3.3(k), while an assumption of liability by the U.S. Government of the United States of the scope referred to in Section 4.02(c3.3(e) is in effect) shall not be reduced reduced, delayed or delayed affected by such requisition. Any payments received by the Mortgagee Agent or the Owner or Permitted Lessee Grantor from such Government Entity government with respect to the use of such requisition of use Airframe or Engines shall be paid over to, or retained by, Grantor; provided that, if such requisition constitutes an Event of Loss, then all of such payments shall be paid over to Agent (so long as the OwnerLien of this Security Agreement has not been duly discharged), and held and applied as provided in Section 3.4(e). In the event of an Event of Loss of an Engine resulting from the requisition for use by a Government Entity government of such Engine (but not the AirframeAirframes (or any of them)), the Owner Grantor will replace such Engine hereunder by complying with the terms of Section 4.04(e3.4(h) and any payments received by the Mortgagee Agent or the Owner Grantor from such Government Entity government with respect to such requisition shall be paid over to, or retained by, the OwnerGrantor.

Requisition for Use.
