REQUIRED CONTRACT DOCUMENT. A Contractor shall document its commitment to meeting the Contract specific MBE and WBE participation goals by submitting a Utilization Plan with the Contract. The Utilization Plan shall include (1) one or more Letter(s) of Intent from the relevant MBE and WBE firms; and (2) current Letters of Certification as an MBE or WBE. Alternatively, the Contractor shall submit (1) a written Petition for Reduction/Waiver with the Contract, which documents its preceding Good Faith Efforts and an explanation of its inability to meet the goals for MBE and WBE participation. The Utilization Plan shall be submitted at the time that the Contract is due. Failure to include a Utilization Plan will render the submission not Responsive and shall be cause for the CPO to reject the Contract.
