Requesting Arbitration. When either party requests that a grievance be submitted to Arbitration, the request shall be made in writing, addressed to the other party of the Agreement. Within five (5) days hereafter, each party shall name an Arbitrator to an Arbitration Board and notify the other party of the name and address of its appointee. If the recipient of the notice fails to appoint an Arbitrator, or if the two appointees fail to agree upon a Chairman within five (5) days, the appointment shall be made by the Minister of Labour upon request of either party.
Requesting Arbitration. The request for arbitration under this Article must be made within 15 days after receipt of the final decision by the Employer or the Union, or, if no final decision is issued, within 15 days from the date each decision should have been issued.
Requesting Arbitration. Any request for arbitration under this Agreement must be made by the employee submitting a written Notice to Guest Services' Director of Human Resources. The Notice shall identify and describe the nature of the claim asserted and the factual basis for such claim. The Notice must be submitted to Guest Services' Director of Human Resources within one year of the date that the act complained of occurred. Acts which occurred more than one (1) year before submission of such Notice shall be deemed forever waived, regardless of any longer limitations period that may be provided by any federal, state or local statute. If Guest Services requests arbitration against you, that claim will be made by Guest Services submitting a written notice to you at your last known address. Such notice is subject to the same requirements as set forth in the immediately preceding paragraph, and will be subject to the same rules as set forth in paragraph 5-7, inclusive.
Requesting Arbitration. A Member wishing to appeal the imposition of a serious disciplinary action shall initiate the appeal by filing a written request with the General Manager within five (5) working days of the date of the Notice of Final Discipline if it was received by the Member or his/her representative. The request shall be addressed to the General Manager , and shall identify the subject matter of the appeal, the grounds for the appeal, and the relief desired by the Member.
Requesting Arbitration. If arbitration is desired by either party, the request will be made to the other party in writing and must be signed by the Union President or the District Engineer or their designee.
