Request for Interim Distribution. When the requirements of Sections 4.5 or 4.6 are satisfied, the Trustee may petition the Bankruptcy Court for an interim order authorizing partial distributions of Axion Shares to persons who will be classified as Category-I Beneficiaries under this Amendment, provided that no interim distributions shall be made in the absence of a finding by the Bankruptcy Court that the Axion Shares to be retained by the Trust after the interim distribution constitute adequate security for Creditors claims and the unresolved claims of other potential Mega-C shareholders.
