Request for Extension or Increase. An Account Party may from time to time request the Issuing Bank to extend the expiration date of an outstanding Letter of Credit or increase (or, with the consent of the beneficiary, decrease) the Stated Amount of or the amount available to be drawn on such Letter of Credit. Such extension or increase shall for all purposes hereunder be treated as though such Account Party had requested issuance of a replacement Letter of Credit (except only that the Issuing Bank may, if it elects, issue a notice of extension or increase in lieu of issuing a new Letter of Credit in substitution for the outstanding Letter of Credit).
Request for Extension or Increase. The Borrower may from time to time request the Lender to extend the expiration date of an outstanding Letter of Credit or increase the Letter of Credit Undrawn Availability of such Letter of Credit. Such extension or increase shall for all purposes hereunder be treated as though the Borrower had requested issuance of a replacement Letter of Credit (except only that the Lender may, if it elects, issue a notice of extension or increase in lieu of issuing a new Letter of Credit in substitution for the outstanding Letter of Credit).

The applicable Applicant may from time to time request, upon at least three (3) Business Days’ notice (given not later than 11:00 a.m. New York City time), that the Bank amend the expiration date of an outstanding LOC, the Available Amount of an outstanding LOC or the language of an outstanding LOC by delivering to the Bank (with a copy to the Parent Guarantor) a written request therefor. Any such request for an extension or increase shall for all purposes hereof (including for purposes of Section 2.02(a)) be treated as though such Applicant had requested issuance of a replacement LOC (except that the Bank may, if it elects, issue a notice of extension or increase in lieu of issuing a new LOC in substitution for the outstanding LOC).

Such extension or increase shall for all purposes hereunder be treated as though such Account Party had requested issuance of a replacement Participated Letter of Credit (except only that the Issuing Bank may, if it elects, issue a notice of extension or increase (or, with the consent of the beneficiary, decrease) in lieu of issuing a new Participated Letter of Credit in substitution for the outstanding Participated Letter of Credit).

An Account Party may from time to time, by a request sent to the Agent, request the Issuing Banks to extend (or request the Issuing Banks to permit the extension, by failing to provide a nonrenewal notice to the beneficiary, of) the expiration date of a Set of Related Letters of Credit or increase (or, with the consent of the beneficiary, decrease) the Stated Amounts of or the amounts available to be drawn on such Related Letters of Credit; provided however, that any such increase (or decrease, as the case may be) shall be made Pro Rata. Such extension or increase shall for all purposes hereunder be treated as though such Account Party had requested issuance of replacement Related Letters of Credit (except only that the Issuing Banks may, if they all so elect, issue a notice of extension or increase with respect to an outstanding Set of Related Letters of Credit in lieu of issuing a new Set of Related Letters of Credit in substitution for an outstanding Set of Related Letters of Credit).
