All representations, warranties and agreements covenants contained in this Agreement or in certificates of officers of the Fund Trust, the Administrator or of the Adviser Investment Advisor submitted pursuant hereto, shall remain operative and in full force and effect, regardless of any investigation made by or on behalf of the any Underwriter or controlling person, or by or on behalf of the Fund Trust, the Administrator or the Adviser Investment Advisor, and shall survive delivery of the Shares AMPS to the UnderwriterUnderwriters.
