Replacement of Documents. Upon receipt of an affidavit of an officer of the Bank and indemnification as to the loss, theft, destruction or mutilation of the Note (or either of them) or any Related Agreement which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon cancellation of the Note or other Related Agreement, the Borrower will issue, in lieu thereof, a replacement Note or other agreement in the same principal amount thereof and otherwise of like tenor.

Upon receipt of evidence reasonably satisfactory to Borrower or Lender of the loss, theft, destruction or mutilation of any of the Combined Documents and, in the case of any such loss, theft or destruction, upon delivery of an indemnity agreement reasonably satisfactory to Borrower or Lender or, in the case of any such mutilation, upon surrender and cancellation of the appropriate document, the other party or parties will execute and deliver, in lieu thereof, a replacement document or instrument supplied by Borrower or Lender, identical in form and substance and dated as of the date of the document being replaced and upon such execution and delivery of such replacement document all references in this Instrument to the document being replaced shall be deemed to refer to such replacement document.
