Common use of Replacement Interest Rate Cap Agreement Clause in Contracts

Replacement Interest Rate Cap Agreement. If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (First Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (First Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (First Mezzanine).

Replacement Interest Rate Cap Agreement. If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (First Fourth Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (First Fourth Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (First Fourth Mezzanine).

Replacement Interest Rate Cap Agreement. If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (First Third Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (First Third Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (First Third Mezzanine).

If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (First Second Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (First Second Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (First Second Mezzanine).

If, in connection with Mezzanine Borrower’s 's exercise of any extension option the Extension Option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (First Mezzanine)Agreement, all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (First Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (First Mezzanine)as of the date that was the Initial Maturity Date.
