Remedy and Procedure for Warranty Coverage. Oxford will, at its sole option, repair a non-conforming Device covered by the warranty in Section 7.1 or replace it with functionally equivalent, reconditioned, or new Device. Oxford will, subject to Customer’s compliance with Section 3.3, replace a non- conforming Flow Cell covered by the warranty in Section 7.1. To the maximum extent permitted by applicable law, these are Customer’s sole remedies and Oxford’s sole warranty obligations.
