RELIANCE ON POLICY. DETERMINATIONS The State shall determine all program policy. The Contractor may from time to time request the State to make policy determinations or to issue operating guidelines required for proper performance of this Contract, and the State's Project Manager shall respond in writing in a timely manner. The Contractor shall be entitled to rely upon and act in accordance with such written policy determinations and operating guidelines, unless subsequently amended, modified or changed in writing by the Department, and shall incur no liability in doing so unless the Contractor acts negligently, maliciously, fraudulent, or in bad faith. Nothing contained in this Contract or in any agreement, determination, operating guideline, or other communication from the Department shall relieve the Contractor of its obligation to keep itself informed of applicable State and federal laws, regulations, policies, procedures and guidelines, and, subject to the provisions of Section 8.5, Change Orders Within Scope, to be in complete compliance and conformity therewith.
