Common use of Release of Liability Clause in Contracts

Release of Liability. The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZ, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom.

Release of Liability. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. I understand and fully acknowledge and agree that all of the risks identified herein and any other risks associated with use of the Sky Zone facility and its equipment are beyond the control of the Releasees. I agree and acknowledge that should SZ or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, I agree to immediately defend, indemnify and hold SZ and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

Release of Liability. The Releasing Parties Despite all known and unknown risks including but not limited to serious bodily injury, permanent disability, paralysis and loss of life, I, on behalf of myself, and/or on behalf of my spouse, minor child(ren)/xxxx(s) hereby foreverexpressly and voluntarily remise, irrevocably and unconditionally release, waiveacquit, relinquish, satisfy and forever discharge from liability and covenant agree not to sue SZxxx CIRCUSTRIX, including its suppliers, designers, installers, manufacturers of any trampoline equipment, foam pit material, or such other material and their successors, predecessors-in-interest, equipment in CIRCUSTRIX’S facility (all hereinafter referred to as “EQUIPMENT SUPPLIERS”) and insurers (collectively, the“Releasees") agree to hold said parties harmless of and from any and all claims, demands, rights, actions, suitsmanner of actions or omission(s), causes of action, obligationssuits, debtssums of money, costs, losses, charges, expenses, attorneys’ feescontroversies, damages, judgments judgments, executions, claims and liabilities, of whatever kind or naturedemands whatsoever, in law, equity law or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releaseesequity, including, without limitationbut not limited to, any claim for negligenceand all claims which allege negligent acts and/or omissions committed by CIRCUSTRIX or any EQUIPMENT SUPPLIERS, failure to warn or other omissionwhether the action arises out of any damage, property damageloss, personal injury, emotional injuryor death to me or my spouse, illnessminor child(ren)/xxxx(s), bodily harm, paralysis while participating in or death. I understand that this release and waiver applies not only to use as a result of participating in any of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I ACTIVITIES in or my Child engage in at about the premises. This Release of Liability, is effective and valid regardless of whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought bydamage, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith death is a result of any act or arising therefromomission on the part of CIRCUSTRIX and/or any EQUIPMENT SUPPLIERS.

Release of Liability. The Releasing Parties On my behalf, and on behalf of Student, My Family and My Guests, and my and their respective spouses, estates, heirs, executors, administrators, assigns, and personal representatives, I hereby foreverrelease, irrevocably and unconditionally releasecovenant not to sue, discharge, waive, relinquish, discharge from liability and covenant not to sue SZhold harmless ACDS, and their respective board members, trustees, administrators, committee members, managers, officers, employees, independent contractors, volunteers, agents, servants, advisors, affiliates, parent corporations, subsidiaries, successors, predecessors-in-interestassigns, insurers, and insurers representatives (collectively, the“Releasees"hereinafter collectively referred to as “Academic Releasees”) of and from any and all claims, demands, rightsliabilities, actions, suitslosses, damages, costs, expenses, and causes of action of any kind, known or unknown, directly or indirectly arising out of or relating to Student’s, My Family’s or My Guests’ participation in Academic Activities wherever located, use of services of ACDS or use of or presence on ACDS facilities, tools, equipment, programs, services, or materials. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of any Academic Releasees, their employees, agents, affiliates, and representatives and others above identified, or third parties. Without limitation of the foregoing, I hereby forever release and waive my right to bring suit against any Academic Releasee in connection with exposure, infection, and/or spread of COVID-19 related to Student’s, My Family’s or My Guests’ participation in Academic Activities wherever located, use of services of ACDS, or use of or presence on ACDS’s facilities, tools, equipment, programs, services, or materials. I understand and agree that this release applies whether the fact of COVID-19 infection has already occurred, whether such occurrence is currently known or unknown, and whether such infection shall or may occur in the future. I understand that these releases mean I give up my right to bring any claims, lawsuits, or causes of action, obligationsincluding claims for personal injuries, debtsdeath, costsdisease, or property losses, chargesor any other loss, expensesand also including, attorneys’ feesbut not limited to, claims of negligence and breach of contract. I understand further that by signing the CE Agreement I give up any claim I may have to seek damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now these damages are known or unknown, suspected foreseen or unsuspectedunforeseen. If I am an employee of ACDS, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipmentCE Agreement does not, and all activities and games at is not intended to, waive any rights I may have as an employee under applicable laws governing my employment with such employer to the Sky Zone Facility. I understand extent that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefromsuch rights may not lawfully be waived.

Release of Liability. The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZ, xxx Wonderfly Events LLC or GRP 4801 Xxxxxx LLC and their successors, predecessors-predecessors- in-interest, and insurers (collectively, the“Releaseesthe “Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Childclient’s access to and/or use of the Sky Zone FacilityWonderfly Arena, premises and/or its equipment (whether trampolines or otherwise)equipment, the Childclient’s and/or my entry into the Sky Zone FacilityWonderfly Arena, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityWonderfly Arena, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityWonderfly Arena, and/or the acts or omissions of SZ Wonderfly or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand The Client understands that this release and waiver applies not only to use of the trampolinesfacility, but also all other equipment, and all activities and games at the Sky Zone Wonderfly Arena Facility. I understand The Client understands that this release and waiver applies to and includes all activities that I or my Child engage the client participates in at the premises, whether inside or outside the Sky Zone Wonderfly Arena Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I the Client shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. The Client understands, fully acknowledges, and agrees that all of the risks identified herein and any other risks associated with use of the Wonderfly Arena facility and its equipment are beyond the control of the Releasees. The Client agrees and acknowledges that should Wonderfly or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, the client agrees to immediately defend, indemnify and hold Wonderfly and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZ, Wonderfly Events LLC or GRP 4801 Xxxxxx LLC and their successors, predecessors-predecessors- in-interest, and insurers (collectively, the“Releaseesthe “Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Childclient’s access to and/or use of the Sky Zone FacilityWonderfly Arena, premises and/or its equipment (whether trampolines or otherwise)equipment, the Childclient’s and/or my entry into the Sky Zone FacilityWonderfly Arena, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityWonderfly Arena, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityWonderfly Arena, and/or the acts or omissions of SZ Wonderfly or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand The Client understands that this release and waiver applies not only to use of the trampolinesfacility, but also all other equipment, and all activities and games at the Sky Zone Wonderfly Arena Facility. I understand The Client understands that this release and waiver applies to and includes all activities that I or my Child engage the client participates in at the premises, whether inside or outside the Sky Zone Wonderfly Arena Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I the Client shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. The Client understands, fully acknowledges, and agrees that all of the risks identified herein and any other risks associated with use of the Wonderfly Arena facility and its equipment are beyond the control of the Releasees. The Client agrees and acknowledges that should Wonderfly or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, the client agrees to immediately defend, indemnify and hold Wonderfly and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZxxx, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise)participation, the Child’s and/or my entry into the Sky Zone Facilityof event, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facilityin. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefromthere from. PHOTO/VIDEO/SOCIAL MEDIA WAIVER In connection with my and/or the Child’s, I consent to the recording of the Child’s and my physical likeness and/or voice through mechanical, photographic, technical, digital, electronic or other means (“Recordings”). I hereby consent to and authorize Releasees and its agents, representatives, employees, successors and assigns to use, in perpetuity, such Recordings, as well as the Child’s name and my name, for any purpose, including advertising, promoting, exploiting and/or publicizing. I further agree that the foregoing includes the consent to use the Child’s and/or my physical likeness in any form. In addition, I waive any and all claims I may have in connection with the Recordings.

Release of Liability. The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZxxx GP, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Galactic Playgrounds Facility, premises and/or its equipment (whether trampolines exhibits or otherwise), the Child’s and/or my entry into the Sky Zone Galactic Playgrounds Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Galactic Playgrounds Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Galactic Playgrounds Facility, and/or the acts or omissions of SZ GP or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Galactic Playgrounds Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Galactic Playgrounds Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZFlip Factory Zone, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone FacilityFlip Factory Zone, premises and/or its equipment (whether trampolines attractions or otherwise), the Child’s and/or my entry into the Sky Zone FacilityFlip Factory Zone, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityFlip Factory Zone, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityFlip Factory Zone, and/or the acts or omissions of SZ Flip Factory Zone or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone FacilityFlip Factory Zone. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone FacilityFlip Factory Zone. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZxxx Happys Family Fun Center, LLC, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Happy Familys Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Happys Family Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Happys Family Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Happys Family Facility, and/or the acts or omissions of SZ Happys Family facilty or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Happys Family Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Happys Family Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom.

Release of Liability. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' ’ fees, associated therewith or arising therefrom. I understand and fully acknowledge and agree that all of the risks identified herein and any other risks associated with use of the Sky Zone facility and its equipment are beyond the control of the Releasees. I agree and acknowledge that should SZ or any other Releasee or anyone acting on their behalf, be required to incur attorneys’ fees and/or costs to enforce this agreement, I agree to immediately defend, indemnify and hold SZ and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

Release of Liability. The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZLiberty Heights, and their successors, predecessors-in-interest, and insurers (collectively, the“Releaseesthe “Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Liberty Heights Facility, premises and/or its equipment (whether trampolines or otherwise), my participation in the Child’s and/or Activities, my entry into the Sky Zone Liberty Heights Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Liberty Heights Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Liberty Heights Facility, and/or the acts or omissions of SZ Liberty Heights or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also my participation in all other equipment, and all activities and games Activities at the Sky Zone Liberty Heights Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Liberty Heights Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom.

Release of Liability. The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZxxx Xxxxxxxx Center, and their its successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, Xxxxxxxx Center premises and/or its equipment (whether trampolines or otherwise)equipment, the Child’s and/or my entry into the Sky Zone FacilityXxxxxxxx Center, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityXxxxxxxx Center, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityXxxxxxxx Center, and/or the acts or omissions of SZ Xxxxxxxx Center or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, equipment and all activities activities, exhibits and games at the Sky Zone FacilityXxxxxxxx Center. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone FacilityXxxxxxxx Center. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. I understand and fully acknowledge and agree that all of the risks identified herein and any other risks associated with use of the Xxxxxxxx Center and its equipment are beyond the control of the Releasees. I agree and acknowledge that should Xxxxxxxx Center or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, I agree to immediately defend, indemnify and hold Xxxxxxxx Center and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue xxx SZ, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand that this release and waiver applies not only to use of the trampolines, but also all other equipment, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. I understand and fully acknowledge and agree that all of the risks identified herein and any other risks associated with use of the Sky Zone facility and its equipment are beyond the control of the Releasees. I agree and acknowledge that should SZ or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, I agree to immediately defend, indemnify and hold SZ and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

Release of Liability. The Releasing Parties hereby foreverI specifically understand that I AM RELEASING, irrevocably and unconditionally DISCHARGING AND WAIVING ANY AND ALL CLAIMS OR ACTION that I may have presently or in the future for the acts or other conduct, whether or not negligent, by BOO, its staff, its owners, directors or officers (the “Released Parties”), by me, or any other third party or person. Furthermore, it is my intention to release, waiveexempt and relieve the Released Parties from any and all liability, relinquishcauses of action, discharge claims and demands that may arise in any way from liability any injury, death, loss, damage, or harm that may occur to me or to any other person or to any property regardless of any negligence on the Released Parties’ part, except to the extent of any of the Released Parties’ gross negligence, intentional or reckless misconduct or any other liabilities not permitted to be contractually excluded under Washington law. I agree to DEFEND, INDEMNIFY AND HOLD Released Parties HARMLESS from and covenant not to sue SZ, and their successors, predecessors-in-interest, and insurers (collectively, the“Releasees") from against any and all claims, demandsincluding claims for their or my negligence, rights, actions, suits, causes of action, obligations, debts, as well as for any and all costs, lossesclaims, chargesexpenses or liabilities arising from my participation or conduct before, expensesduring or after kayaking, including but not limited to attorneys’ fees, damages, judgments fees and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the Sky Zone Facility, premises and/or its equipment (whether trampolines or otherwise), the Child’s and/or my entry into the Sky Zone Facility, the condition, maintenance, inspection, supervision, control or security of the Sky Zone Facility, the failure to warn of dangerous conditions in connection with the Sky Zone Facility, and/or the acts or omissions of SZ or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or deathcourt costs. I understand that this release and waiver applies agree not only to use of xxx or make a claim against the trampolinesReleased Parties for death, but also all other equipmentinjuries, and all activities and games at the Sky Zone Facility. I understand that this release and waiver applies to and includes all activities that I or my Child engage in at the premises, whether inside or outside the Sky Zone Facility. In the event that any claim released herein is brought byloss, or asserted on behalf ofharm that may occur before, during, or after the Releasing Parties, I shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefromkayaking activity.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZWonderfly Events LLC or 1919 Greenspring, LLC and their successors, predecessors-predecessors- in-interest, and insurers (collectively, the“Releaseesthe “Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Childclient’s access to and/or use of the Sky Zone FacilityWonderfly Arena, premises and/or its equipment (whether trampolines or otherwise)equipment, the Childclient’s and/or my entry into the Sky Zone FacilityWonderfly Arena, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityWonderfly Arena, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityWonderfly Arena, and/or the acts or omissions of SZ Wonderfly or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand The Client understands that this release and waiver applies not only to use of the trampolinesfacility, but also all other equipment, and all activities and games at the Sky Zone Wonderfly Arena Facility. I understand The Client understands that this release and waiver applies to and includes all activities that I or my Child engage the client participates in at the premises, whether inside or outside the Sky Zone Wonderfly Arena Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I the Client shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. The Client understands, fully acknowledges, and agrees that all of the risks identified herein and any other risks associated with use of the Wonderfly Arena facility and its equipment are beyond the control of the Releasees. The Client agrees and acknowledges that should Wonderfly or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, the client agrees to immediately defend, indemnify and hold Wonderfly and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.

The Releasing Parties hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue SZxxx Wonderfly Events LLC, Xxxxxx Xxxxx LLC, or GRP 4801 Xxxxxx LLC and their successors, predecessors-in-interest, and insurers (collectively, the“Releaseesthe “Releasees") from any and all claims, demands, rights, actions, suits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Childclient’s access to and/or use of the Sky Zone FacilityWonderfly Arena, premises and/or its equipment (whether trampolines or otherwise)equipment, the Childclient’s and/or my entry into the Sky Zone FacilityWonderfly Arena, the condition, maintenance, inspection, supervision, control or security of the Sky Zone FacilityWonderfly Arena, the failure to warn of dangerous conditions in connection with the Sky Zone FacilityWonderfly Arena, and/or the acts or omissions of SZ Wonderfly or any of the Releasees, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death. I understand The Client understands that this release and waiver applies not only to use of the trampolinesfacility, but also all other equipment, and all activities and games at the Sky Zone Wonderfly Arena Facility. I understand The Client understands that this release and waiver applies to and includes all activities that I or my Child engage the client participates in at the premises, whether inside or outside the Sky Zone Wonderfly Arena Facility. In the event that any claim released herein is brought by, or asserted on behalf of, the Releasing Parties, I the Client shall immediately defend, indemnify and hold harmless the Releasees, and any of them, from any loss or liability, including reasonable attorneys' fees, associated therewith or arising therefrom. The Client understands, fully acknowledges, and agrees that all of the risks identiked herein and any other risks associated with use of the Wonderfly Arena facility and its equipment are beyond the control of the Releasees. The Client agrees and acknowledges that should Wonderfly or any other Releasee or anyone acting on their behalf, be required to incur attorneys' fees and/or costs to enforce this agreement, the client agrees to immediately defend, indemnify and hold Wonderfly and any other Releasee or them harmless for and against all such attorneys’ fees and/or costs.
