Release by Water Entities for Project Costs. Upon each payment from Cooperating Respondents to a Water Entity of Project Costs incurred by a Water Entity from and after the Effective Date of this Agreement, that Water Entity, on behalf of itself and its successors and assigns, hereby agrees to release, acquit and forever discharge each CR Affiliate from any and all actions, causes of action, claims, demands, liabilities, damages, penalties, debts, losses, costs, expenses and fees (including without limitation litigation costs and attorney and consultant fees) of every kind and nature whatsoever, in law and in equity in connection with the Project, but only to the extent of such payment.
