RELEASE AND WAIVER OF LIABILITY.  I hereby apply to participate in the Old Mill Arts & Antiques Festival promoted by the Utica Parks & Recreation Commission.  I hereby fully and forever release, discharge, and agree not to xxx the City of Utica or any event sponsors, officers, directors, agents, employees, representatives, and successors for any and all claims caused of action or liability for any injury, loss or damage sustained or incurred by me arising out of or in any way associated with my attendance at or participation in the event, including all claims, causes of action or liability arising out of the negligence of the event sponsors, their agents or representatives.  I agree to indemnify and hold harmless event sponsors, their agents or representatives from any loss, damage or expense sustained or incurred by them arising from any such claims, cause of action or liability, whether brought by me, anyone acting on my behalf, or anyone else because of conduct attributed to me.  This agreement shall be construed and interpreted according to the law of the State of Michigan.  I understand and agree that this Release and Waiver shall be binding upon my heirs, assigns any personal entity acting upon my behalf, including a parent, guardian, or next of kin.  Food concessionaires will be required to set up in the “Food Court” and not within the Festival route. RELEASE AND WAIVER OF LIABILITY.  I hereby apply to participate East Pennsboro Township to rent and use the facility, or facilities during the dates and times as mentioned in the Old Mill Arts & Antiques Festival promoted attached application, for a private and/or public function. I understand that by renting this or these facilities I will expose myself and my guests to normal risks of injury or harm associated with nature, sporting events and activities, picnics, social gatherings, musical events, and/or passive recreational activities. I hereby assume all risk and responsibility of damage to the Utica Parks & Recreation Commissionproperty of East Pennsboro Township as it relates to my event and my use and/or misuse; and hold East Pennsboro Township, its agents and representatives harmless for any and all suits relating to the use of Township owned facilities.  I hereby fully and forever release, discharge, and agree not to xxx the City sue East Pennsboro Township, any of Utica their officials, elected or any event sponsorsappointed, employees (past or present), and contractors/vendors (past or present), sponsors or their officers, directors, agents, employees, ’ representatives, and successors for any and all claims caused claims, causes of action or liability for any injury, loss or damage sustained or incurred by me or my guests arising out of or in any way associated with my our attendance at or participation in the eventmy event through this contracted rental. I have read the guidelines regarding use of Township Facilities and agree to assume responsibility for observance of these regulations. I shall agree to assume all responsibility for any damages incurred beyond normal wear and tear and I also assume all liability for personal damages or injuries incurred through use of the facility and relieve East Pennsboro Township and its officials of any responsibilities for such activities. I understand that a parentportion of the rental fee may be non-refundable and may not be returned in case of cancellation. RELEASE AND WAIVER OF LIABILITY.  At each Tournament, the Promoter shall collect the signature of every Tournament player and umpire on Tournament roster forms (the "Roster Forms") by which each such player and umpire shall acknowledge and agree to the following release and waiver of liability clause, which must appear on each Roster Form exactly as set forth below with the missing information in [brackets] filled in. The Promoter also shall collect the signature of each team manager (or, with respect to umpires, the Tournament director) to acknowledge that he/she personally witnessed each Tournament player (or, as applicable, umpire) sign the Roster Forms.
