Common use of Release and Discharge Clause in Contracts

Release and Discharge. 11.1 The acceptance by the Designer of the last payment under the provisions of Article 6.5 or Article 12 in the event of termination of the Contract, shall in each instance, operate as and be a release to the Owner and the Authority and their employees and officers, from all claims of the Designer and its Subconsultants for payment for services performed and/or furnished, except for those written claims submitted by the Designer to the Owner with, or prior to, the last invoice.

Release and Discharge. 11.1 The acceptance by the Designer Owner’s Project Manager of the last payment under the provisions of Article 6.5 7 or Article 12 in the event of termination of the Contract, shall in each instance, operate as and be a release to the Owner and the Authority and their employees and officersagents, from all claims of the Designer Owner’s Project Manager and its Subconsultants for payment for services performed and/or furnished, except for those written claims submitted by the Designer Owner’s Project Manager to the Owner and Authority with, or prior to, the last invoice.

Release and Discharge. 11.1 12.1 The acceptance by the Designer of the last payment for services paid under the provisions of Article 6.5 or Article ARTICLES 11 and 12 in the event of contract termination of the Contract, shall in each instance, instance operate as and be a release to the Owner Awarding Authority, and the Authority and their employees and officersevery member or agent thereof, from all claims of and liability to the Designer and its Subconsultants for payment for on account of services performed and/or furnishedor reimbursable expenses incurred under this AGREEMENT, except for those written claims submitted by the Designer to the Owner with, or prior to, Awarding Authority with the last invoicepayment requisition.

Release and Discharge. 11.1 The acceptance by the Designer of payment of the last payment installment under the provisions of paragraph 5.6, or a final payment under the terms of Article 6.5 or Article 12 11 in the event of termination of the Contractcontract, shall in each instance, operate as and be a release to the Owner Authority and the Authority Department and their employees and officersagents, from all claims of the Designer and its Subconsultants sub-consultants and subcontractors for payment for services performed and/or furnished, except for those written claims submitted by the Designer to the Owner Authority or Department with, or prior to, the last invoice.

Release and Discharge. 11.1 The acceptance by the Designer of the last payment for services paid under the provisions of Article 6.5 12 or under Article 12 13 in the event of termination of the Contractcontract, shall in each instance, operate as and be a release to the Owner Town, the OFFICE, and the Authority every member and their employees and officersagent thereof, from all claims claim and liability to the Designer for everything done or furnished for or relating to the work, or for any act or neglect of the Designer and its Subconsultants for payment for services performed and/or furnishedOFFICE of any person relating to or affecting the work, except for those written claims submitted by the Designer to the Owner with, or prior to, OFFICE with the last invoicepayment requisition.
