REJECTED DEVICE Clause Samples
The REJECTED DEVICE clause defines the procedures and consequences when a device provided under the agreement does not meet specified requirements or is otherwise deemed unacceptable by the receiving party. Typically, this clause outlines the criteria for rejection, the process for notifying the supplier, and the obligations for removal, replacement, or repair of the rejected device. Its core function is to ensure quality control and protect the buyer from being obligated to accept or pay for devices that fail to conform to agreed standards or specifications.
REJECTED DEVICE. If the Device is considered to be a Rejected Device, the Plan will be terminated with no refund of Your Service Fee or payment of the Buyback Amount, and you will be notified by e-mail and/or in a secure area on TechForward's website within thirty (30) days of receipt of Device by TechForward ("Rejection Notification"). You hereby grant TechForward the power to dispose or sell the Rejected Device with TechForward retaining 75% of the net proceeds of the sale ("Rejected Device Sale Proceeds"). The remainder of the Rejected Device Sale Proceeds will be disbursed to You within sixty (60) days of the sale of the device.
REJECTED DEVICE. If the Device is considered to be a Rejected Device you will be given your Rejected Device back for you to do with it as you choose. The Rejected Device may be eligible for Best Buy’s Electronics Recycling Program. You are responsible for additional charges that apply should you elect to participate in the Best Buy Electronics Recycling Program.
REJECTED DEVICE. If PURCHASER rejects the Device in accordance with this Section 8, then, at SELLER’s expense and discretion, PURCHASER shall return to SELLER any such shipment, or any part thereof, that does not comply with the Device Specifications, and receive in exchange therefore at the option of PURCHASER, either (i) a complete refund of the Purchase Price, taxes paid and not recoverable, and shipping costs associated with the Device in form of a credit note, or (ii) fully compliant replacement Device(s). If the Parties so agree, PURCHASER shall destroy any non-conforming Device, at SELLER’s expense and in accordance with all applicable legal requirements. While SELLER is investigating the rejection, payments of purchased goods subject to such rejection shall be put on hold until claim response is given.
