Common use of Reinstatement of Guaranty Clause in Contracts

Reinstatement of Guaranty. If any payment or transfer of any interest in property by Debtor to Secured Party is rescinded or must be returned by Secured Party to Debtor, (a) this Guaranty shall be reinstated with respect to any such payment or transfer, even if this Guaranty was previously returned or canceled, and (b) Guarantor shall remain fully liable with respect to any such amount as if such amount had not been paid by Debtor.

Reinstatement of Guaranty. If this Guaranty is returned or canceled, and subsequently any payment or transfer of any interest in property by Debtor the Company to Secured the any Lender Party in fulfillment of any Obligation is rescinded or must be returned by Secured the Lender Party to Debtorthe Company, (a) this Guaranty shall be reinstated with respect to any such payment or transfer, even if this Guaranty was previously returned or canceled, and (b) Guarantor shall remain fully liable with respect to regardless of any such amount as if such amount had not been paid by Debtorprior return or cancellation.

Reinstatement of Guaranty. If this Guaranty is revoked, returned, or canceled, and subsequently any payment or transfer of any interest in property by Debtor Borrower to Secured Party is rescinded or must be returned by Secured Party to DebtorBorrower, (a) this Guaranty shall be reinstated with respect to any such payment or transfer, even if this Guaranty was previously returned or canceled, and (b) Guarantor shall remain fully liable with respect to regardless of any such amount as if such amount had not been paid by Debtorprior revocation, return, or cancellation; and any guaranty of any indemnities, shall survive any termination of this Guaranty.

Reinstatement of Guaranty. If this Guaranty is revoked, returned, or canceled, and subsequently any payment or transfer of any interest in property by Debtor the Borrower to Secured Party the Bank is rescinded or must be returned by the Secured Parties to the Borrower for any reason, or is repaid by any Secured Party to Debtorin whole or in part in good faith settlement of any pending or threatened avoidance claim, (a) this Guaranty shall be reinstated with respect to any such payment or transfer, even if this Guaranty was previously returned or canceled, and (b) Guarantor shall remain fully liable with respect to regardless of any such amount as if such amount had not been paid by Debtorprior revocation, return, or cancellation.
