Common use of Regulatory Position Clause in Contracts

Regulatory Position. The Agent is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority. Nothing in this Agreement shall require the Agent to carry on an activity of the kind specified by any provision of Part II (other than article 5 (accepting deposits)) of the Financial Services and Markets Act 0000 (Xegulated Activities) Order 2001 or to lend money to any Borrower in its capacity as Agent.
