Common use of Regulations as to Borrowing Clause in Contracts

Regulations as to Borrowing. Subject to any statute or regulation which (i) regulates the incurrence of any Debt, including, without limitation, statutes or regulations relative to common or interstate carriers or to the sale of electricity, gas, steam, water, telephone, telegraph or other public utility services and (ii) is applicable to 40 either the incurrence by Borrower of Borrower's Obligations or the incurrence by Guarantors of Guarantors' Obligations.
