Reference Indices Sample Clauses

Reference Indices. Except as otherwise provided in section 1.2(j)(iii) of this EPA and section 2 of Appendix C, if any rating, index, tariff or price quotation referred to in this EPA ceases to be published, or if the basis therefor is changed materially, there will be substituted an available replacement index, tariff or price quotation that most nearly, of those then publicly available, approximates the intent and purpose of the index, tariff or quotation that has so ceased or changed. This EPA will be amended as necessary to accommodate such replacement index, tariff or price quotation, all as determined by written agreement between the Parties, or failing agreement, by arbitration under section 8.5.

Reference Indices. XI.2.1 LU Index: Average Hourly Earnings for Industry classification "Aircraft and Parts," 1987 SIC Code 372, not seasonally adjusted; as it appears in the periodical "Employment and Earnings," under the section "Not Seasonally Adjusted," Monthly Establishment Data, Hours and Earnings - National, in Table B-15. Average hours and earnings of production and non-supervisory workers on private non-farm payrolls by detailed industry; as published by the Bureau of Labor Statistics of the U.S. Department of Labor and obtained from the BLS website within one week of the delivery of each Aircraft.
Reference Indices. If any index or price quotation referred to in this Agreement ceases to be published, or if the basis therefor is changed materially, there will be substituted an available replacement index or price quotation that most nearly, of those then publicly available, approximates the intent and purpose of the index or price quotation that has so ceased or changed and this Agreement shall be amended as necessary to accommodate such replacement index or price quotation, all as determined by written agreement between the Parties, or failing agreement, by mandatory and binding arbitration under Section 15.2, without having the Settlement Conference referred to in Section 15.1.
