Reference Committee. (a) The Reference Committee may, as contemplated in this Agreement, make recommendations to the MSC. (b) The MSP shall inform physicians of their right to refer matters relating to their medical accounts to the Reference Committee where: (i) there is a disagreement between the physician and the MSP with respect to an account or accounts, that is not resolved within 60 days from the date that a written enquiry, from the physician, is received by the MSP; or (ii) there is a disagreement between the physician and the MSP over payment for services or procedures for which no fee has been established and approved by the MSC, that is not resolved within 60 days from the date that a written enquiry, from the physician, is received by the MSP. (c) The Reference Committee shall promptly review all matters referred to it and shall forward its recommendations to the MSC within one month of its meeting or to the Tariff Committee or MSP as appropriate. (d) When the MSC accepts the recommendation of the Reference Committee to pay a Fee for Service Account as submitted by a physician, the MSP shall pay the account with interest at the rate provided for in and in accordance with Regulation 215/83 of the Financial Administration Act. (e) The Reference Committee shall meet to review matters referred to it at least three times per calendar year and the period between successive meetings is not to exceed six months. A recommendation by the Reference Committee is not binding on the MSC. However, the MSC will endeavour to follow the recommendations of the Reference Committee. This does not in any way circumscribe or ▇▇▇▇▇▇ the duties, rights and discretions of the MSC under the Medicare Protection Act. (f) The approved costs of the Reference Committee will be shared equally by the MSP and the BCMA.
Reference Committee. (a) The Reference Committee of the BCMA shall be considered to be an advisory committee to the Commission under Section 5(l)(o) of the Act. (b) The MSP shall inform physicians of their opportunity to refer to the Reference Committee matters relating to medical accounts submitted by the physician where: i. there is a continuing disagreement between the physician and the MSP which exceeds 60 days from the date the physician first raises a written enquiry to the MSP with respect to an account or accounts; or ii. there is a continuing dispute with the physician over payment for services or procedures which exceeds 60 days from the date the physician first raises a written enquiry to the MSP for which no fee has been established and approved by the Commission. (c) The Reference Committee shall promptly review all matters referred to it and shall forward its report or recommendations to the Commission and the BCMA within one month of its meeting or to the Tariff Committee or MSP as appropriate. (d) The Reference Committee shall meet to review matters referred to it at least three times per calendar year and the period between successive meetings is not to exceed six months.
