Referee. Following the filing of a Complaint, either Party may seek the appointment of a Referee in accordance with the terms hereof and pursuant to California Code of Civil Procedure, section 638(1). At the hearing thereon, the non-complaining Party may select one of the Referees from the list of referees served concurrently with the Complaint, and that Referee shall be appointed as the Referee for the Dispute. Should the non-complaining Party not select one of the Proffered Referees, or should it reject the proffered Referees, the court shall select one of the proffered Referees, or should it reject the proffered Referees, the court shall select a Referee, qualified as described below, in accordance with California Code of Civil Procedure Section 640.
