Real Estate Agent. The parties agree that BUYER has no responsibility for the payment of any real estate agent or brokerage fees incurred in the sale of the PROPERTY.
Real Estate Agent. Landlord and Tenant each represent and warrant to the other that no agents were involved in the negotiation of this Lease except that it is disclosed in the Lease Agreement to which this is an Exhibit. Each party agrees to indemnify the other against claims for commission by individuals, entities or agents claiming entitlement to compensation by virtue of its representation of the indemnifying party.
Real Estate Agent. Each of the Seller and the Buyer: (i) represents and warrants to the other that it has not employed, been represented by or otherwise dealt with any real estate agent, broker or finder in connection with the sale and purchase of the Property other than Colliers International and that no commission, fee or other compensation is payable in connection with the sale and purchase of the Property except as may be provided in a separate writing signed by the party who is liable for payment of such compensation; and (ii) agrees to indemnify, defend and hold the other harmless from and against any and all claims, damages, losses, liabilities, costs and expenses (including without limitation reasonable attorneys' fees and court costs) arising out of or in connection with any breach of the foregoing representation and warranty.
Real Estate Agent. 15 ARTICLE 27
Real Estate Agent. Each Party represents and warrants to the other Parties that such Party is not represented by a real estate agent, broker or other person or entity who may claim a commission or payment arising from the transactions contemplated by this Agreement, and agrees to indemnify the other Parties if any such agent, broker, person or entity claims a commission or other remuneration by reason of representation or being a procuring cause of the sale through the indemnifying Party.
Real Estate Agent. The Purchaser warrants that the Purchaser was not introduced to the Vendor or to the Property directly or indirectly by any real estate agent other than the Vendor's Estate Agent. The Purchaser indemnifies and shall keep indemnified the Vendor (and if more than one, each of them) against any Claims, suits, demands and actions by any agent or any other person arising out of or as a consequence of a breach of this warranty. This Special Condition shall not merge on Settlement of this Contract.
Real Estate Agent. The Buyer is aware that Midwest Land and Home, LLC, is acting as an Agent for the Seller with the duty to represent the Seller's interest. The agent is not an agent for the prospective Buyer, and any information given to the agent will be disclosed to the Seller. Seller and Xxxxx acknowledge that the Disclosure of Real Estate Brokerage Relationship form has been furnished to the parties. The sales commission will be paid by Seller. The real estate firm involved in this transaction are agents only and not parties to thiscontract and will in no case whatsoever be held liable to either party for performance of any term or condition of this agreement or for damages for non-performance. Xxxxx acknowledges that said firm has made no representations and has given no express or implied warranties with regard to the condition of the subject property. Seller and Xxxxx agree that the real estate firm shall not be responsible for the conduct of third parties providing specialized services whether those services were arranged by Xxxxxx, Buyer or the real estate firm on behalf of either.
Real Estate Agent. Each of the parties represents and warrants that no real estate agent or broker was involved in the negotiation or consummation of this Lease. Landlord shall hold Tenant harmless from all fees and commissions claimed by any broker arising from the consummation of this Lease, excepting any broker claiming by or through Tenant, for which claims Tenant shall hold Landlord harmless. The indemnifications contained herein shall include court costs, reasonable out of pocket costs and attorneys’ fees at the trial and appellate levels.
Real Estate Agent. 18. The parties respectfully represent that no real estate commission is due, Buyer Seller the parties not having dealt with a real estate broker or salesperson in regard to this sale. or
