RACE Clause Samples

The RACE clause establishes the rules and procedures for resolving situations where multiple parties have competing claims or interests in the same asset or right. In practice, this clause typically determines the priority of claims based on the order in which they are filed, registered, or otherwise perfected, such as in the context of liens, mortgages, or intellectual property rights. By clearly setting out how priority is established, the RACE clause helps prevent disputes and provides certainty to parties about their standing relative to others with similar claims.
RACE. The driver who will start the race must be appointed by his team at the latest 1 hour after the end of the qualifying tests, by completing the appropriate form. Penalty: at the discretion of the panel stewards or See Appendix 1. It will no longer be possible to change the driver at the start, except in cases of force majeure. The driver declared at the start must be the driver behind the wheel at all times from the start of the start procedure until the moment the race is started.
