The 'Quality-related Changes' clause establishes the procedures and rights for modifying products, services, or processes to address quality concerns. Typically, this clause allows one party—often the buyer or client—to request changes if the delivered goods or services do not meet agreed-upon quality standards, and may outline timelines, responsibilities, and approval processes for implementing such changes. Its core function is to ensure that quality issues can be promptly and formally addressed, thereby protecting the interests of both parties and maintaining the expected standard of deliverables.
Quality-related Changes. In the event Supplier implements a recall or other quality-related change to any Standard Component or Custom Component located in a Hub, Supplier will notify EMS Provider and the Cisco Entities of the change, including whether the Component can be reworked at the Hub and the date on which Supplier will have replacement or re-worked Components available at the Hub. Upon agreement between Supplier and EMS Provider to the changes proposed, Supplier will carry out such changes or replace such Component in the Hub. Supplier will undertake such activities at its own expense.
Quality-related Changes. If either Party determines that changes are necessary for safety or due to the epidemic failure of the Products or parts and components thereof to perform in accordance with the Product Specifications, or to meet the Quality Standards set forth in the Turnkey Design and Manufacturing Agreement. WISTRON shall respond with a written corrective action response plan as soon as reasonably possible, and WISTRON shall execute such plan to enable XPLORE to make the required changes in installed Products and Products in production within a reasonable time frame.
Quality-related Changes. If either Party determines that changes are necessary for safety or due to the epidemic failure of the Products or parts and components thereof to perform in accordance with the Product Specifications, or to meet the Quality Standards set forth in Exhibit II, Appendix C, METROLOGIC shall respond with a written corrective action response plan as soon as possible but no later than three (3) business days after notification, and METROLOGIC shall execute such plan to enable SYMBOL to make the required changes in installed Products and Products in production within fifteen (15) business days after notification by SYMBOL to proceed with such plans. METROLOGIC shall promptly make the appropriate engineering changes by implementing Engineering Change Orders ("ECOs") within such fifteen (15) day period to all such affected Products and parts thereof to be delivered to SYMBOL thereafter.
