Common use of Qualified Persons Clause in Contracts

Qualified Persons. Both the Employer and the Association shall have the right to strike two (2) names from the panel. The party requesting arbitration shall strike the first name; the other party shall then strike one name. The process will be repeated, and the remaining person shall be the arbitrator. Notwithstanding the foregoing, if the parties mutually agree in writing after Step 3 of the grievance procedure to submit the grievance to the American Arbitration Association, said grievance shall be submitted to said Association in accordance with the voluntary labor arbitration rules of said Association. The award of an Arbitrator so selected upon any grievance subject to arbitration as herein provided shall be final and binding upon all parties to this Agreement, provided that no arbitrator shall have any authority or jurisdiction to add to, detract from, in any way alter the provisions of this Agreement. The expense for the arbitrator’s services shall be borne equally by the Employer and the Association; however, each party shall be responsible for compensating its own representatives and witnesses.
