Common use of Qualification, Name Clause in Contracts

Qualification, Name. Each of Borrower and the REIT shall qualify and remain qualified to do business in each jurisdiction in which any Portfolio Property is located or in which the nature of its business requires it to be so qualified except for those jurisdictions where failure to so qualify would not have a material Adverse Effect on Borrower. Borrower will transact business solely in its own name or in the commonly known name of one of the Portfolio Properties.
