Qualification for Assignment Clause Samples

The Qualification for Assignment clause sets specific conditions or requirements that must be met before a party can transfer its rights or obligations under a contract to another party. Qualification for Assignment. Vacancies including athletics, extracurricular, and other stipended positions shall be filled from within where practicable. All appointments and assignments to any and all vacancies and openings shall be based on qualifications, experience, and certification. Every unsuccessful applicant will be advised of the filling of the vacancy as soon as possible after the same is filled. Unsuccessful applicants who are represented by the Association shall, upon request, be furnished with an explanation as to why they did not receive the appointment to such vacancy.

Unsuccessful applicants who are existing employees of the Board in the negotiating unit represented by the Association shall, upon request, be furnished with an explanation as to why they did not receive the appointment to such vacancy.
Qualification for Assignment. All appointments and assignments to any and all vacancies and openings shall be based on professional qualifications, training, experience and seniority and shall be made only to certificated teachers or teachers pursuing a course of study approved by the State of New York for certification. Except for teachers presently employed in the Arlington School System and/or teachers holding life certificates, all teachers hereafter employed in the Arlington School System shall hold a baccalaureate degree from an accredited college. Appointments shall be made without regard to age, sex, race, creed, color, religion, nationality, marital status, or ancestry, unless based upon a bona fide occupational qualification. Qualification for Assignment. Appointments and assignments to vacancies and openings within the bargaining unit shall be given to qualified persons. In making appointments and assignments, rotation and equitable distribution of such appointments and assignments may be considered. In the event that there are no qualified applicants from the bargaining unit for posted positions, as determined by the Superintendent, the administration may make appointments to such posted positions within the bargaining unit from outside the unit. Assignments shall be made without regard to age, sex, race, creed, color, nationality, marital status or ancestry, and every unsuccessful applicant who is an existing employee of the Board will be advised of the filling of the vacancy as soon as possible.
