QQQ. Nasdaq and the QQQ Trust shall grant to Amex, pursuant to the License Agreement attached hereto as Exhibit E, a license to continuously: (i) list exclusively and, on a non-exclusive basis, trade and market QQQ Domestically until ****; and (ii) list, trade and market, QQQ in each Foreign region until ****, on a non-exclusive basis beginning on ****, provided, however, that in Asia such license shall begin on ****.
