Typically, it sets boundaries on making public statements, press releases, or social media posts that reference the contract, the parties involved, or the subject matter of the agreement. This clause helps prevent unauthorized or potentially damaging disclosures, ensuring that sensitive information is protected and that public messaging remains consistent and controlled.

Citizens in the educator group should feel free to speak out on such matters to their fellow citizens without fear of District censorship or discipline. However, an educator should take into account both the content and the method of presentation of any public criticisms as to their potential for improving the educational system and the long-range benefits they may have for students. An educator should not knowingly distort or misrepresent facts concerning educational matters directly or indirectly, or use personal invective in his/her public expressions of opinion. Each educator should clearly distinguish in his/her public statements between personal opinions and when he/she may be serving as a spokesperson for the District or the Association. Public expression as defined by the U.S. Supreme Court decisions, provide the following guidelines:

Public expression. When a faculty member speaks or writes, his/her special position imposes special obligations. The public may judge his/her co-faculty members and/or the college by his/her utterances. Hence, the faculty member shall at all times try to be accurate and should show respect for the opinion of others.

This written Agreement and Disclosure may not be contradicted by evidence of any alleged oral agreement. Should any part of this Agreement or the Disclosure be found to be invalid or unenforceable, all other parts of this Agreement and Disclosure shall remain in effect and fully enforceable to the fullest extent possible under this Agreement.
