Provisional Certification. The Regional Heritage Program Leader, the SHPO, or the ACHP may also recommend that the Regional Forester place a Forest or Ranger District on provisional status based on findings from any of the reviews specified at Stipulation 5.5 of this PA or other identified deficiencies. Provisional status may extend from one to two years, although the term of the provisional status shall be determined by the Regional Forester and shall reflect the complexity of the deficiencies identified. While on provisional status, a Forest or Ranger District will have the opportunity to correct deficiencies that have been identified. Progress in resolving identified deficiencies shall be reported to the Regional Heritage Program Leader every six months or whenever such information is requested by the Heritage Program Leader. Upon expiration of the provisional status term, the Regional Forester, in consultation with the SHPO, shall determine whether identified deficiencies have been satisfactorily corrected. Should the Regional Forester determine that such deficiencies remain uncorrected, or should new deficiencies that the Regional Forester or other Signatories deem significant be identified, provisional status may be extended, or the suspension and decertification process shall be initiated as described at Stipulation 11.3 of this PA.
Provisional Certification. The Class is provisionally certified, for settlement 24 purposes only, as follows: 25 All persons (which includes entities such as firms, companies, corporations, associations, and public entities) who, between July 24, 2016 and the date this Order 26 is entered, were Account Holders, but excluding (a) any officer or council member of the Town; (b) any judge assigned to hear this case; and (c) persons who timely 27 and properly exclude themselves from the Class as provided in this Agreement.
Provisional Certification. The DPO or either SHPO may recommend that the SD place a Field Office on a provisional status based on findings from any of the reviews specified at Stipulation 8.3. Upon expiration of the provisional status term, the parties to this Protocol shall convene to determine whether identified deficiencies have been satisfactorily corrected. Should the parties determine that such deficiencies remain uncorrected, or should new deficiencies be identified that the parties deem significant, the decertification process shall be initiated as described below.

The Settlement Class is provisionally certified as a class of: All users and subscribers of the cellular telephone numbers and South Carolina area code telephone numbers identified in the Call Log as receiving an IHP Call from IHP’s dialing system from October 22, 2015 through August 14, 2020.

The Class is provisionally certified as: All Lamps 9 Lamps Plus website from January 4, 2015, through the date of preliminary approval, one or more 10 Lamps Plus branded, trademarked or otherwise proprietary merchandise which Lamps Plus 11 advertised with a “Compare” or “Compare At” reference price. Excluded from the Class are 12 Lamps Plus’s Counsel, Lamps Plus’s officers, directors and employees, and the judge presiding 13 over the Action.

Excluded from the Class are New York & Company’s Counsel, New York 24 & Company’s officers, directors and employees, and the judge presiding over the Action.
Provisional Certification. The Settlement Class is provisionally certified as a class of all persons in the United States who were a regular user or subscriber to numbers assigned to wireless carriers to which a call was made or attempted by AAG, either directly or by Complete Business Marketing Company, LLC DBA Exclusive Prospect (“EP”) for the benefit of AAG, using any automated telephone dialing system or artificial or prerecorded voice message, or a regular user or subscriber to phone numbers that were not assigned to wireless carriers to which a call was made or attempted by AAG either directly or by EP for the benefit of AAG, from January 1, 2017 to May 1, 2020. Excluded from the Class are the Court, the officers and directors of AAG, and persons who timely and validly request exclusion from the Settlement Class. The Class Period is from January 1, 2017 through May 1, 2020.
