Common use of PROV Clause in Contracts

PROV. 5 Should the premises not be available for occupancy on the first day of the lease term, the Lessee will have no obligation to make rental payments until occupancy is available. The Lessor agrees that liquidated damages in the amount of per day shall be deducted from subsequent rental payments due from the Lessee, for the period from the first day of the lease term until the premises are ready for occupancy. If the premises are not available for occupancy days after the first day of the lease term, the lessee may terminate the Real Estate Lease Agreement.
