Proposed Procedures for the Classification of Teacher Assistants. Notwithstanding the provisions of this Collective Agreement, unless otherwise stated, the following shall apply to the reassignment, transfer, lay-off, job postings and staff changes involving the classification of Teacher Assistants only:
1. The Teacher Assistant classification shall be divided into six (6) geographical school regions as described in Appendix “E”. If during the term of this Agreement any new school is established under the jurisdiction of the Employer then the geographical location of such new school shall determine which region it will fall into. Each of the regions shall be used for the purposes of determining the manner in which Teacher Assistant positions shall be assigned and/or posted.
2. On or before June 15 of each year the Employer shall determine the number of reassignments that are required to occur for the following school year, including the specific region in which such reassignments are to occur as well as any increase or decrease in the Teacher Assistant complement within each region and the Union shall be notified of the foregoing.
3. Any increase in Teacher Assistant positions within any region shall be posted to the Union on or before June 15th in accordance with the posting provisions (Article 18) of this Agreement.
4. In the event of any decrease in Teacher Assistant positions within any region as determined by the Employer, an equal number of Teacher Assistant positions within the region in which the reduction occurs shall be subject to lay-off based on the least senior Teacher Assistants employed in that region being laid off in reverse order of seniority.
5. Any Teacher Assistant laid off in accordance with the provisions of Article 18.04(4) shall then be entitled to exercise their rights pursuant to Article 17 of this Agreement (Layoff and Recall).
6. Upon completion of the procedures set out in article 4 above, in the event that it is necessary to reassign any Teacher Assistants within a particular region all positions available for reassignment within that region shall be placed on a “First Voluntary Assignment List - Region # ” and all Teacher Assistants within that region shall be entitled to apply for any reassignment position and the appointment to such position shall be determined by seniority (First Voluntary Assignment List).
