Common use of Proportionate Liability Clause in Contracts

Proportionate Liability. (a) The liability of the NOPs to the Owner Participant and the directors, officers, employees and agents of the Owner Participant under the indemnities contained in clauses 24.1(a) and 24.2(a) is reduced proportionately to the extent that an act or omission of the Owner Participant, its directors, officers, employees, agents, contractors or Subcontractors (other than the NOPs and their subcontractors and agents) has contributed to the loss, damage or claim.

Proportionate Liability. (a) The liability of the NOPs to the Owner Participant and the directors, officers, employees and agents of the Non-Owner Participant under the indemnities contained in clauses 24.1(a22.1(a) and 24.2(a22.2(a) is reduced proportionately to the extent that an a negligent act or omission of the Owner Participant, its directors, officers, employees, agents, contractors or Subcontractors (other than Subcontractors, or a breach of this Agreement by the NOPs and their subcontractors and agents) has Owner Participant, contributed to the loss, damage or claim.

(a) The liability of the NOPs to the Non-Owner Participant and the directors, officers, employees and agents of the Owner Participant Participants under the indemnities contained in clauses 24.1(a22.1(a) and 24.2(a22.2(a) is reduced proportionately to the extent that an act or omission of the Owner Participant, its directors, officers, employees, agents, contractors or Subcontractors (other than the NOPs and their subcontractors and agents) has may have contributed to the loss, damage or claim.
