Property Release Fund Clause Samples

Property Release Fund. All Property Release Prepayments, DSCR Satisfaction Prepayments, Out-Parcel Prepayments and Out-Parcel DSCR Satisfaction Prepayments deposited with Lender as of any Payment Date shall be applied by Lender on such Payment Date toward the prepayment of the Loan in accordance with Section 2.3 hereof. Amounts so deposited shall be referred to as the “Property Release Fund”. In no event shall the application of the Property Release Fund by Lender pursuant to this Section 7.7 be deemed an exercise of any remedy Lender may have pursuant to the terms of this Agreement and the other Loan Documents or at law or in equity.
